A menudo, el testamento del ser querido es la \u00faltima palabra sobre c\u00f3mo se distribuir\u00e1n sus bienes. Pero, \u00bfqu\u00e9 ocurre si crees que ese testamento no es justo o no cumple con la ley?<\/span><\/strong><\/p>\n<p>Impugnar un testamento no es una decisi\u00f3n que deba tomarse a la ligera, pero es un derecho que la ley reconoce en circunstancias muy concretas. En este art\u00edculo, te explicamos de forma sencilla los motivos por los que se puede impugnar un testamento seg\u00fan el <strong><a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-2008-13533\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Libro cuarto del C\u00f3digo Civil de Catalu\u00f1a, relativo a las sucesiones<\/a><\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<h4>\u00bfCu\u00e1les son los motivos para impugnar un testamento?<\/h4>\n<p>La ley catalana es muy clara y establece causas tasadas. No se puede impugnar un testamento simplemente porque no est\u00e1s de acuerdo con el reparto. Los motivos principales son:<\/p>\n<p><strong>1. Vicios en la Voluntad del Testador<\/strong> Este es uno de los motivos m\u00e1s comunes. Se basa en que la persona que hizo el testamento no actu\u00f3 con total libertad y conocimiento. Seg\u00fan el <strong><a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-2008-13533#a4222\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art\u00edculo 422-2. Nulidad de disposiciones testamentarias.<\/a><\/strong>, un testamento puede ser nulo si se otorg\u00f3 con:<\/p>\n<ul>\n<li><strong>Enga\u00f1o:<\/strong> Si se manipul\u00f3 al testador con mentiras o artima\u00f1as para que cambiara su voluntad.<\/li>\n<li><strong>Violencia o Intimidaci\u00f3n Grave:<\/strong> Si se le coaccion\u00f3 o amenaz\u00f3 de forma seria para que testara de una determinada manera.<\/li>\n<li><strong>Error en la persona o el objeto:<\/strong> Si el testador se equivoc\u00f3 sobre a qui\u00e9n dejaba sus bienes o sobre qu\u00e9 bienes dejaba, y ese error fue determinante.<\/li>\n<\/ul>\n<p><strong>2. Defectos de Forma<\/strong> Un testamento es un acto solemne y debe cumplir unos requisitos formales para ser v\u00e1lido. Si no se cumplen, puede ser nulo. Un ejemplo claro es la falta de testigos cuando la ley los exige. El <strong><a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-2008-13533#a42110\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art\u00edculo 421-10. Testigos.<\/a><\/strong> establece que son necesarios si el testador, por ejemplo, no sabe o no puede firmar. La <a href=\"https:\/\/app.maite.ai\/search?id=1999819&amp;type=jurisprudencias\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Sentencia de la Audiencia Provincial de Barcelona 54\/2019<\/a> anul\u00f3 un testamento precisamente porque la testadora ten\u00eda graves dificultades de visi\u00f3n y no se incluyeron testigos que garantizaran que entend\u00eda lo que firmaba.<\/p>\n<p><strong>3. Ineficacia por Crisis de Pareja<\/strong> Este es un supuesto muy pr\u00e1ctico y frecuente. El <strong><a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-2008-13533#a42213\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art\u00edculo 422-13. Ineficacia sobrevenida por crisis matrimonial o de convivencia.<\/a><\/strong> establece que las disposiciones a favor del c\u00f3nyuge o pareja de hecho devienen ineficaces si, despu\u00e9s de hacer el testamento, se produce una separaci\u00f3n (legal o de hecho), divorcio o cese de la convivencia.<\/p>\n<p>La ley presume que, de haber podido, el testador habr\u00eda cambiado el testamento. Solo se mantendr\u00eda la disposici\u00f3n si del propio testamento se deduce que el testador la habr\u00eda mantenido igualmente, como se analiza en la <a href=\"https:\/\/app.maite.ai\/search?id=3012608&amp;type=jurisprudencias\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Sentencia de la Audiencia Provincial de Barcelona 757\/2020<\/a>.<\/p>\n<p><strong>4. Preterici\u00f3n de un Legitimario<\/strong> Los \u00ablegitimarios\u00bb (en Catalu\u00f1a, principalmente los hijos y, en su defecto, los padres) tienen derecho a una parte de la herencia llamada \u00ableg\u00edtima\u00bb. Si el testador olvida u omite a un legitimario sin haberlo desheredado legalmente, se produce una \u00abpreterici\u00f3n\u00bb. Seg\u00fan el <strong><a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-2008-13533#a4227\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art\u00edculo 422-7. Ineficacia por preterici\u00f3n err\u00f3nea.<\/a><\/strong>, el legitimario omitido puede impugnar el testamento para reclamar lo que por ley le corresponde.<\/p>\n<p><strong>5. Desheredaci\u00f3n Injusta<\/strong> Un testador puede privar a un legitimario de su leg\u00edtima, pero solo por las causas graves y espec\u00edficas que marca la ley (por ejemplo, maltrato o ausencia manifiesta y continuada de relaci\u00f3n familiar por culpa del legitimario). Si la causa que se alega en el testamento no es cierta o no se puede probar, el desheredado puede impugnar la desheredaci\u00f3n, tal como regula el <strong><a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-2008-13533#a45120\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art\u00edculo 451-20. Impugnaci\u00f3n de la desheredaci\u00f3n.<\/a><\/strong>.<\/p>\n<h4>\u00bfQu\u00e9 ocurre si la impugnaci\u00f3n tiene \u00e9xito?<\/h4>\n<p>Si un juez declara la nulidad del testamento, las consecuencias dependen de cada caso, pero generalmente, seg\u00fan el <strong><a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-2008-13533#a4224\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art\u00edculo 422-4. Consecuencias de la nulidad y la caducidad.<\/a><\/strong>:<\/p>\n<ol>\n<li>La herencia se regir\u00e1 por el <strong>testamento anterior v\u00e1lido<\/strong>, si lo hubiera.<\/li>\n<li>Si no hay testamento anterior, se abrir\u00e1 la <strong>sucesi\u00f3n intestada<\/strong>, y la herencia se repartir\u00e1 seg\u00fan el orden que establece la ley (primero descendientes, luego c\u00f3nyuge o pareja, etc.).<\/li>\n<\/ol>\n<h4>Consejos Pr\u00e1cticos para Nuestros Clientes<\/h4>\n<p>Si te encuentras en una situaci\u00f3n en la que crees que un testamento puede ser impugnado, ten en cuenta lo siguiente:<\/p>\n<ul>\n<li><strong>El tiempo es clave:<\/strong> La ley establece plazos de caducidad para actuar. Generalmente, la acci\u00f3n para impugnar un testamento o una desheredaci\u00f3n caduca a los <strong>cuatro a\u00f1os<\/strong> desde la muerte del testador (<strong><a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-2008-13533#a43110\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art\u00edculo 431-10. Acci\u00f3n de nulidad.<\/a><\/strong>). Pasado ese tiempo, pierdes tu derecho a reclamar.<\/li>\n<li><strong>Re\u00fane toda la documentaci\u00f3n:<\/strong> Es fundamental recopilar el testamento, el certificado de defunci\u00f3n y, sobre todo, cualquier prueba que fundamente tu reclamaci\u00f3n (informes m\u00e9dicos que acrediten la falta de capacidad del testador, pruebas de la coacci\u00f3n, documentos que demuestren la separaci\u00f3n de la pareja, etc.).<\/li>\n<li><strong>Act\u00faa con rapidez, pero con estrategia:<\/strong> No dejes pasar el tiempo. Una evaluaci\u00f3n inicial de la viabilidad de tu caso es crucial para no iniciar un procedimiento judicial sin posibilidades de \u00e9xito.<\/li>\n<li><strong>Busca asesoramiento especializado:<\/strong> El derecho de sucesiones catal\u00e1n tiene muchas particularidades.
